Mobile Myotherapy & Remedial Massage – Home Visit Terms & Conditions

These Terms and Conditions ("Terms") govern the provision of mobile Myotherapy / Remedial Massage services by SM Therapy ("Practitioner") to the Client ("You"). By booking or receiving treatment, you agree to be bound by these Terms in full.

These Terms comply with the ethical and professional standards of the Australian Traditional-Medicine Society (ATMS), NSW Health regulations, and SM Therapy’s professional indemnity and public liability insurance policies.

1. Scope of Practice & Professional Standards

SM Therapy provides services within the defined scope of Myotherapy and Remedial Massage therapy as recognised by ATMS and leading industry standards.

These treatments are aimed at assessing, preventing, and managing musculoskeletal pain, dysfunction, and soft tissue conditions through evidence-informed manual therapy techniques.

Treatment techniques may include:

  • Soft tissue massage
  • Myofascial release
  • Trigger point therapy
  • Dry needling (if qualified and consented)
  • Cupping
  • Stretching and mobility techniques
  • Corrective exercise advice

These services do not replace medical diagnosis or treatment from a licensed medical or allied health practitioner.

2. Health & Hygiene – Client Responsibilities

To ensure safety and align with NSW Health public health expectations, clients must not book or receive treatment if experiencing or having recently experienced:

  • Fever, sore throat, cough, congestion, body aches, or fatigue
  • Gastrointestinal illness (e.g. vomiting, diarrhoea)
  • Shortness of breath, chest tightness, or loss of taste/smell
  • Skin infections, rashes, or any condition that may be contagious
  • Tested positive for COVID-19, Influenza, or other transmissible illness in the last 7 days
  • Been identified as a close contact of someone unwell with a communicable disease in the last 5 days

Failure to disclose relevant symptoms or illness history may result in cancellation of the session and potential barring from future bookings.

3. Practitioner Infection Control Measures

SM Therapy follows strict infection control protocols:

  • Hand hygiene before and after each session
  • Clean, single-use linens for every client
  • Disinfection of all equipment and high-touch items between appointments
  • Optional or required PPE based on public health advice

4. Treatment Space Requirements (Client Responsibility)

Clients are responsible for providing a suitable space for mobile therapy. The area must:

  • Be clean, safe, and private (minimum 2.5m x 2.5m)
  • Be indoors, well-ventilated, and free of hazards
  • Have a flat and accessible entry for equipment setup
  • Allow safe, legal parking access nearby

Children, pets, or other individuals must not be in the treatment area unless pre-approved due to disability support or similar reasons. The Practitioner reserves the right to terminate the session if the space is unsafe or non-compliant.

5. Professional Conduct & Safety

To uphold a safe and respectful environment:

  • Any sexual, suggestive, inappropriate, threatening, aggressive, or abusive behaviour will result in immediate termination of treatment, with full fees still payable
  • Harassment, coercion, discrimination, or intimidation will not be tolerated
  • The Practitioner reserves the right to report misconduct to ATMS, health authorities, or law enforcement as needed

6. Fees, Payment, Travel & Cancellation Policy

  • Fees vary based on treatment type, session length, and travel distance
  • A travel surcharge may apply depending on your suburb or access difficulty
  • Full payment is due on the day of service by cash, EFTPOS, bank transfer, or approved health fund rebate

Cancellation Policy:

  • 24 hours' notice is required to cancel or reschedule an appointment
  • Late cancellations (under 24 hours) will incur a 50% cancellation fee
  • No-shows or unavailable premises on arrival will be charged the full treatment fee
  • Exceptions for genuine medical emergencies may be considered at the Practitioner’s discretion

7. Informed Consent & Disclosure

By booking and receiving Myotherapy / Remedial Massage, you acknowledge that:

  • You have disclosed all relevant medical history, allergies, medications, and conditions
  • You consent to the treatment methods used, tailored to your needs
  • You are aware of potential post-treatment effects (e.g. soreness, bruising, fatigue)
  • You understand that results are not guaranteed and may vary
  • Consent may be withdrawn at any time during the session

8. Limitation of Liability & Indemnity

To the extent permitted by law, SM Therapy shall not be held liable for any injury, symptom aggravation, or dissatisfaction where:

  • The Client failed to disclose health information
  • The Client failed to follow post-treatment advice
  • Outcomes varied due to pre-existing or undiagnosed conditions

The Client agrees to indemnify and hold harmless the Practitioner and SM Therapy from any claims, damages, or costs arising from:

  • Breach of these Terms
  • Unsafe premises or conditions
  • Behavioural misconduct
  • Medical incidents related to undisclosed health issues

9. Privacy & Confidentiality

All client information is protected in line with the Privacy Act 1988 (Cth) and relevant health records legislation. Information is only shared with third parties:

  • With your written consent
  • Where required by law
  • To protect life or prevent serious harm

Client records are stored securely and may be retained for up to 7 years, or longer where legally required.

10. Right to Refuse or Discontinue Service

  • The Practitioner reserves the right to refuse any booking where safety, hygiene, access, or behaviour is unacceptable
  • Sessions may be terminated immediately if conditions breach these Terms
  • Future bookings may be declined for previous violations
  • No refund will be issued for services refused or discontinued due to the Client's breach

11. Agreement to Terms

By proceeding with a booking or receiving treatment, you confirm that:

  • You have read, understood, and voluntarily agreed to these Terms
  • You accept responsibility for disclosing your health history
  • You understand the limitations of treatment outcomes
  • You consent to treatment based on the Practitioner’s professional judgement within the scope of Myotherapy and Remedial Massage
